Miley Cyrus Nude Photo: “It Wasn’t Me”


Last week, a Canadian blogger posted a nude photo purportedly of teen star Miley Cyrus.  The blogger, Zack Taylor, claimed that Miley had her purse stolen at a party with her iPhone in it that contained the racy photo. 
The website Gossip Cop now reports the photo is a fake and that the star is considering legal action.  (The woman in the photo is missing Miley’s signature “Just breathe” tattoo beneath her left breast.)
If Miley does sue, the case would be similar to the claim filed by Anna Kournikova against Penthouse magazine back in 2002.  Penthouse published topless photos purportedly of the tennis star sun bathing topless on a Florida beach.  It turned out the photos were not of Kournikova but of Judith Soltesz-Benetton, an ex-model and daughter in law of Italian fashion designer Luciano Benetton.  Both Soltesz-Benetton and Kournikova filed suits against Penthouse for violation of their rights of publicity.  The judge in the Soltesz-Benetton case seemed sympathetic to the girls’ claims, and temporarily enjoined Penthouse from further distributing the issue containing the photos. Penthouse apologized for the mistake and ultimately settled both actions.
The prospect of substantial monetary damages may have caused the Canadian blogger to think twice about his post.   Zack Taylor is now prominently reporting he got it wrong
We’ll see if the Cyrus camp forgives the mistake.
